Terms of Use

1. Acceptance of Terms

By accessing or using the Alva Health platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, Cookie Policy, and Medical Disclaimer. If you do not agree, you must not use our services.

3. Eligibility

• Be at least 13 years of age
• If aged 13–15, have verifiable parental or guardian consent
• Have the legal capacity to enter into a binding contract
• Not be prohibited from receiving our services under applicable law

The CGM sensor subscription is intended for wellness and lifestyle purposes only and is not suitable for individuals with Type 1 diabetes, pregnant women, or individuals under active clinical supervision without healthcare professional approval.

4. The Services

4.1 Platform services

• Access to the Alva mobile application
• EVA metabolic intelligence engine — AI-powered personalised metabolic insights
• CGM data integration and analysis
• Sleep, activity and dietary pattern analysis
• Personalised recommendations and guidance

4.2 CGM sensor subscription

Where your subscription includes CGM sensors, we will ship sensors to your registered delivery address on the schedule corresponding to your plan. Full regulatory details are in Appendix A.

4.3 Service availability

We aim to provide continuous availability but do not guarantee uninterrupted access. Scheduled and emergency maintenance may temporarily affect access.

5. Important Medical Disclaimer

• EVA’s recommendations are based on pattern analysis and are not clinically validated medical advice
• CGM readings should not be used for insulin dosing without fingerprick confirmation
• If you experience a medical emergency, call emergency services immediately
• The platform does not replace your relationship with your healthcare provider

6. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@alva.health if you suspect unauthorised access. You may not share your account with another person.

7. Subscriptions and Payment

7.2 Billing and renewal

Subscriptions are billed in advance on a monthly or multi-month basis. Payment is processed by Stripe. By subscribing, you authorise us to charge your payment method automatically on a recurring basis until you cancel.

Subscriptions renew automatically at the end of each billing period. We will send a renewal reminder by email at least 7 days before your next billing date.

7.3 Cancellation

You may cancel at any time through your account settings or by contacting support@alva.health. Cancellation takes effect at the end of your current billing period. You retain access to the platform until that date.

7.4 Refunds

We do not issue refunds for partial billing periods except where required by applicable law. EU and UK consumers have the right to withdraw from a contract within 14 days of purchase where the service has not yet commenced (Consumer Rights Directive 2011/83/EU). By beginning to use the service immediately, you acknowledge that the 14-day cancellation right ends at the point of first use.

7.5 App Store and Google Play purchases

If you purchase a subscription through Apple App Store or Google Play, the relevant App Store or Google Play terms and conditions apply to your purchase. In-app purchases are governed by Apple’s or Google’s refund and cancellation policies. We are unable to process refunds for App Store or Google Play purchases directly — contact Apple or Google support.

7.6 Price changes

We will provide at least 30 days’ notice of price changes. Continued use after the effective date constitutes acceptance of the new price.

8. CGM Sensors and Hardware

See Appendix A for full CGM manufacturer and regulatory details. Key terms:

• CGM sensors supplied are manufactured by Zhejiang PocTech Co., Ltd. (REF ZKCTT01101)
• EU device: T-300D TRANSMITTER · EC Rep: Prolinx GmbH, Dusseldorf
• UK device: CT-300D TRANSMITTER · UK Responsible Person: Obelisk LTD, Oxford
• Returns: contact support@alva.health within 7 days of receipt for damaged or defective sensors
• Activated sensors cannot be returned for hygiene and regulatory reasons

9. Intellectual Property and Trademarks

Trademarks

ALVA® and EVA® are registered trademarks of Alva Health GmbH. All rights reserved. Unauthorised use of these trademarks, including in domain names, product names, or marketing materials, is strictly prohibited without the prior written consent of Alva Health GmbH.

All other trademarks, service marks, and trade names referenced on the platform are the property of their respective owners.

All content, software, algorithms, and designs on the platform, including EVA and the EPIC 22 intelligence engine, are owned by or licensed to Alva Health. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial use only.

10. AI Features and Beta Services

EVA is an AI-powered metabolic intelligence engine. The following additional terms apply to AI features:

• EVA’s outputs are recommendations only and should not be treated as clinical advice
• AI predictions improve over time — early-stage outputs may be less accurate than those after 7+ days of learning
• We may offer beta features from time to time. Beta features are provided ‘as is’ without warranty and may be discontinued at any time
• You must not attempt to extract, replicate, or reverse engineer EVA’s underlying model or EPIC 22 architecture
• You must not use AI prompt injection or adversarial inputs designed to manipulate EVA’s outputs

11. Open Source Software

The Alva platform incorporates open source software components. A full list of open source components and their licences is available at alva.health/open-source. Nothing in these Terms of Use restricts rights granted to you under applicable open source licences.

12. Prohibited Conduct

• Violate any applicable law or regulation
• Access or attempt to access another user’s account or data
• Reverse engineer or decompile any part of the platform
• Upload or transmit malicious code
• Use the platform for commercial purposes without written consent
• Scrape or harvest data from the platform by automated means
• Conduct AI prompt abuse, model extraction, or automated API abuse
• Impersonate Alva Health or any other person or entity

13. Force Majeure

Alva Health shall not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to: acts of God, pandemic, war, terrorism, civil unrest, government action, labour disputes, failure of third-party infrastructure or internet services, cyberattacks, or other events beyond our reasonable control.

Where a force majeure event persists for more than 30 days, either party may terminate the affected services on written notice without liability, subject to pro-rata refund of any prepaid subscription fees.

14. Limitation of Liability

• Our total aggregate liability shall not exceed the total amount paid by you in the 12 months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not liable for decisions made based on EVA’s recommendations without independent professional verification

15. Indemnification

You agree to indemnify Alva Health from any claims, damages, and expenses (including legal fees) arising from your use of the platform or breach of these terms.

16. Termination

We may suspend or terminate your account if you breach these terms, we are required to by law, or your use poses a risk to the platform or other users. You may terminate at any time by contacting support@alva.health.

We will notify you of material changes at least 14 days before they take effect. Continued use after that date constitutes acceptance.
